OPA denied the appeal in part due to a proper review by an evaluation committee and lack of evidence of bad faith in the part of DPW.
2014-09-29 BP-A086 Commonwealth Utilities Corporation Solar Photovolatic Generation.  OPA dismissed the appeal by Coldwell Solar, Inc. for lack of jurisdiction.  The CNMI Legislature created a limited exception to OPA jurisidiction over CUC procurement appeals for Private Sector Assistance Agreements.  The disputed RFP falls within that exception.
2014-04-14 BP-A085 Department of Public Works Security Services for Marpi Solid Waste Facility. OPA denies Mary's Security Services' Appeal of the cancellation of DPW12-RFP-004. If the Department of Public Works or the Director of Procurement and Supply wishes to terminate Contract Number 561372-OC, it must be done pursuant to the terms of the contract or the CNMI Procurement Regulations.
2014-03-31 BP-A084 Commonwealth Utilities Corporation CUC Fuel Supply. OPA denies the appeal of IP&E as to the cancellation of RFP-13-015 based on the broad discretion of CUC over such matters as well as the authority granted to CUC by its Procurement Regulations to cancel a procurement where specifications must be revised. IP&E failed to identify any bad faith or wrongdoing by CUC in its decision to cancel the RFP.
2014-03-03 BP-A083 Commonwealth Utilities Corporation Supply and Delivery of Engine Lube Oils for Power Generation. The appeal by NAPA is denied. OPA concludes CUC had discretion to set reasonable specifications for the items it procured and to determine suitability of products that were proposed.
2013-11-01 BP-A080.1 Water Task Force Million Gallon Reservoir Replacement. GPPC's request for reconsideration is denied. OPA finds that the Director of Procurement and Supply's determination that GPPC was non-responsible bidder was reasonable.
2013-10-08 BP-A082 Department of Public Works Procurement of Security Services for the Marpi Solid Waste Facility. Due to the cancellation of the procurement, at this time, the pending appeal has become moot, and is therefore dismissed without prejudice. If Mary's decides to protest the cancellation, that protest must be first brought to P&S, and go through the normal administrative process as set forth in the CNMI Procurement Regulations.

2013-10-02 BP-A075.1 Commonwealth Utilities Corporation Renewable Energy Development. KUTh Energys' Request for Reconsideration of OPA Appeal Decision BP-A075 with respect to CUC-RFP-13-048 is hereby denied.
2013-07-26 BP-A075 Commonwealth Utilities Corporation In the Appeal of KUTH ENERGY. The appeal of KUTh as to the -024 RFP is granted. KUTh's protest is remanded to the Director of Procurement & Supply who shall rule on the merits of the protest in a timely manner.

2013-01-08 BP-A072 Water Task Force In Re: GPPC. GPPC's appeal is granted. OPA directs Procurement & Supply to cancel its notice of award to Fanter and award the contract resulting from the ITB to the second lowest, responsive, responsible bidder.
2012-12-06 BP-A071 Department of Public Works In Re: GPPC Appeal, DPW12-IFB-010. GPPC has no standing to protest the pending award to Hawaiian Rock. Without a basis of protest, GPPC has no standing to appeal for the same reasons. Accordingly, the appeal is dismissed for lack of standing.

2011-06-07 BP-A066 Commonwealth Health Center Medical / Dental Bill Collection Services for the Commonwealth Health Center. In his Decision on Appeal, the Public Auditor affirms the denial of the protest by the Director of the Division of Procurement and Supply.
2011-04-06 BP-A065 Public School System Network Design & Installation of Routing and Switching Equipment for the Public School System. The Public Auditor finds that PSS did not err in awarding the contract to PacStar. OPA urges PSS to make its own determination of PacStar's tax liability on the Network Health Assessment (or forward the issue to OAG) and ensure that any monies owed to the CNMI government are paid.

2009-02-10 BP-A057 Northern Marianas College IN RE APPEAL OF ISLAND BUSINESS SYSTEMS & SUPPLIES. This is a decision on an appeal filed by Island Business Systems & Supplies (IBSS) from the denial of its protest of NMC RFP 08 - 007 for copiers by the President of the Northern Marianas College (NMC). OPA finds that IBSS failed to file its original protest in a timely manner, and thus NMC was correct in its determination to essentially deny the protest.

This is the Office of the Public Auditor’s Decision on the Appeal filed by Resources Management International Corporation (RMIC) appealing the Protest Decision of the Director of Procurement and Supply (Director). 2008-02-15 BP-A054 Department of Corrections IN RE APPEAL OF BOLIS-R-US CATERING. This is the Office of the Public Auditor’s Decision on the Appeal filed by Bolis-R-Us Catering (Bolis). The Appeal was based on the Decision issued by the Secretary of Finance (Secretary) on a protest filed by Bolis regarding ITB 07-DOC-112. OPA finds that the Appeal filed by Bolis was not filed timely as required by § 70-30.3-505(c). OPA further finds that the conditions set forth in § 70-30.3-505(c) that would allow consideration of an appeal that has not been filed timely do not exist. As such, the Appeal is dismissed.
2008-07-02 BP-A053 Public School System IN RE APPEAL OF ALLIED CONSTRUCTION CORPORATION. This is a decision on an appeal filed by Allied Construction Corporation doing business as Barny’s Pizza (Barny’s), through Mark B. Hanson, Attorney at Law, from the denial of Barny’s protest by the Commissioner of Education (Commissioner) regarding PSS-RFP-07-025 (the RFP) issued by the Public School System (PSS). The Office of the Public Auditor (OPA) has
jurisdiction over this Appeal as provided in the Public School System Procurement Rules and Regulations (PSS-PR) as set forth in Chapter 60-40 of the Northern Mariana Islands Administrative Code (NMIAC). OPA finds that the Appeal was brought after award; that no fraud or bad faith on the part of the contractors that were granted awards under the RFP was alleged or exists; and, that it is in the best interest of PSS and the Commonwealth to affirm the contracts. As such, the Appeal is denied.
2007-07-20 BP-A052 Commonwealth Utilities Corporation IN RE APPEAL OF Telesource, CNMI, Inc. This is the Office of the Public Auditor’s Decision on the Appeal filed by Telesource, CNMI, Inc.
(Telesource). The Appeal was based on the failure of the Director of the Division of Procurement and Supply (P&S Director) and the Executive Director of the Commonwealth Utilities Corporation (CUC Executive Director) to act on a protest filed by Telesource regarding CUC
RFP 07-001 (RFP). OPA finds that the procurement process involving CUC RFP 07-001 was not in compliance with the CNMI-PR and, therefore, orders it hereby cancelled pursuant to CNMI-PR § 70-30.3-510(a)(1).
2007-04-02 BP-A051 Water Task Force IN RE APPEAL OF REACTION CO. This is the Office of the Public Auditor’s Decision on the Appeal filed by Reaction Co. (Reaction)
appealing the Director of the Division of Procurement and Supply’s (Director) denial of Reaction’s Protest regarding the cancellation of IFB 06-GOV-003, the procurement for the installation of 7,000water meters, by the Water Task Force (WTF) and the subsequent solicitation for installation of 7,000 water meters through IFB 06-GOV-097. OPA finds that the cancellation of IFB 06-GOV-003 was allowable under the CNMI-PR. OPA
further finds no compelling reason presented to justify OPA ordering the cancellation of IFB 06-GOV-097. Reaction’s Appeal, therefore, is denied.

2006-01-25 BP-A048 Northern Mariana Islands Housing Corporation IN RE APPEAL OF ISLAND BUSINESS SYSTEMS & SUPPLIES. This is a decision on an appeal filed by Island Business Systems & Supplies (IBSS) from the denial of its protest by the Director of the Division of Procurement and Supply (Director) regarding the procurement of a copier machine from Xerox Corporation (Xerox) by the Northern Mariana Islands Housing Corporation (NMHC). OPA finds that the solicitation and the resulting lease agreement for a photocopier from Xerox were not in conformity with the CNMI-PR and, therefore, grants the appeal as set forth herein.

2004-08-05 BP-A043 Commonwealth Utilities Corporation IN RE APPEAL OF J&A ENTERPRISES. This is an appeal filed by J&A Enterprises (J&A), through the Law Offices of O’Connor Berman Dotts & Banes, from the denial of J&A’s protest by the Executive Director of the
Commonwealth Utilities Corporation (CUC) regarding CUC-IFB-04-03. The Office of the Public Auditor (OPA) has jurisdiction of this Appeal as provided in Section 5-102 of Commonwealth Utilities Corporation’s Procurement Regulations (CUC-PR)(Commonwealth Register Vol. 12, No. 6 (1990), adopted in Vol. 13, No. 8 (1991)). OPA finds that the Decision of the Executive Director was erroneous in its denial of J&A’s protest based on its finding that J&A’s protest was untimely pursuant to CUC-PR 5-101(1)(a). OPA further finds that it is now uncontested that JMI did not fully meet the bid specification. As the contract awarded to JMI has been cancelled, however, no further remedy is available under the CUC-PR in this matter.
