Telesource appeal on CUC RFP denied in part, granted in part
(July 21, 2008)
OPA released its decision on the appeal filed by Telesource CNMI, Inc. from the denial of its protest by the Executive Director of the Commonwealth Utilities Corporation (CUC) regarding CUC Request for Proposals (RFP) No. 07-015. In OPA's decision, the appeal was denied in part and granted in part.
OPA found that:
- Telesource had standing to file its protest and appeal;
- The Telesource protest was filed timely;
- Use of competitive sealed proposals in instances when price is not the only factor is within the discretion of the (Executive) Director;
- OPA cannot find that the (Executive) Director had violated CUC Procurement Regulations (CUC-PR) section 50-50-225(a); and
- The evaluation criteria set forth in the RFP did not comply with the requirements set forth in CUC-PR section 50-50-225(e).
According to OPA, the RFP should be reviewed and modified to comply with the CUC-PR, specifically section 50-50-225(e).
